This document explains the terms on which Sarvar Inshoot (hereinafter the "Developer") sells apartments in the Navoi Sozanda residential complex in the city of Tursunzoda: what the Developer offers, what the price is made up of, which payment options are available, and how and when a contract is concluded.
1. What the Developer offers
The Developer builds and sells apartments in the Navoi Sozanda residential complex in the city of Tursunzoda. Sales are conducted by construction phases and blocks; the composition of the phases, the number of storeys, the floor plans and the areas are published on the Site.
The characteristics of a particular apartment — block, floor, number, area, layout — are stated by the sales department and are fixed by the contract. Before a contract is concluded, selecting an apartment on the Site secures nothing for you.
2. Price
The price of an apartment is derived from its area and the rate per square metre. The rate depends on the block, the floor and the payment option chosen.
The amounts shown by the Site and by the calculator are computed at the current rate. The rate for the apartment you have chosen and the final amount are stated by the sales department and are fixed in the contract.
Settlements are made in the national currency — somoni.
A price fixed in the contract is changed only by agreement of the parties and in the manner provided for by the contract.
3. Payment options
Payment in full — the entire price is paid in the manner and within the time limits established by the contract.
Instalments with a down payment — part of the price is paid on conclusion of the contract, and the balance is spread over a payment schedule.
Instalments without a down payment — the entire price is spread over a payment schedule.
The instalment plan is provided by the Developer itself, without a bank and without interest for the use of the instalments. The maximum instalment term is up to 36 months.
The amount of the down payment, the instalment term, and the amounts and dates of the payments depend on the option chosen and are fixed in the payment schedule, an annex to the contract. The rate per square metre may differ between payment options.
4. How a contract is concluded
A request on the Site, a call or a message in a messenger is an enquiry for a consultation. A request does not reserve an apartment, does not fix a price and does not signify agreement to conclude a contract — neither on your part nor on the part of the Developer.
After the enquiry, a manager clarifies the parameters of the apartment, the current price and the payment option. The reservation procedure, if a reservation is required, is stated by the sales department — a reservation is arranged separately from a request.
Before signing, you have the right to examine the draft contract and all annexes to it, including the payment schedule.
The contract is concluded in writing and is deemed concluded from the moment it is signed by both parties or, where the legislation requires state registration of such a contract, from the moment of that registration.
Until a contract is concluded, the Developer is under no obligation to hand over an apartment.
5. Timelines
The planned construction and handover dates are published on the Site. The handover date for your apartment is established by the contract.
If the handover date changes, the Developer notifies the buyer in the manner provided for by the contract.
6. Governing law and dispute resolution
The relations of the parties are governed by the legislation of the Republic of Tajikistan.
The parties shall seek to resolve disputes through negotiation. A claim is sent in writing to the address of the Developer given below. The time limit for replying to a claim is 30 (thirty) calendar days from the date of its receipt, unless the contract establishes a different time limit.
If no agreement is reached, the dispute is considered by a court in the manner established by the legislation of the Republic of Tajikistan.
